Over the past fifty years, businesses have become the target of an ever-increasing number of lawsuits for a variety of tort claims, including products liability, toxic torts, civil rights, defamation, premise liability and professional negligence, to name a few. Given this climate, it has become very important for businesses to have counsel and advice from a law firm that has the experience and knowledge to handle such lawsuits and claims. Through its Tort Defense Group, Meyer, Unkovic & Scott LLP can handle virtually any type of tort claim that may be asserted against its business clients. For example, in the area of products liability, the attorneys of the Tort Defense Group regularly represent both insurance company insured and self-insured manufacturers in connection with claims involving a wide range of products and product lines, including asbestos, automotive components and equipment, chemicals, electrical and electronic defenses and components, medical devices, sporting goods and other recreational products and industrial machinery.
In addition to representing clients in individual products liability cases, the Firm's attorneys in the Tort Defense Group have been retained by product manufacturers to coordinate the defense of products claims on a regional or national basis. In fact, one of the Group's attorneys is currently the national coordinating counsel for a manufacturer of spinal implants, which work includes handling individual cases throughout Pennsylvania and certain other states, as well as supervising other cases nationwide.
However, the Tort Defense Group's expertise in tort matters is not limited to the defense of product liability matters. The Group's attorneys routinely represent clients involved in a broad range of tort actions. Some examples of the types of actions in which the Group's lawyers are typically involved include the following:
- Representation of several large hotels chains in claims brought by persons injured and/or assaulted on the premises.
- Defense of a non-profit organization and its board president in connection with deformation claim brought by one of the organization's former officers.
- Defense of a public agency in a variety of civil rights cases.
- Representation of architects and contractors in connections with the demolition of a large building.
- Representation of a barge company in an action brought by an injured worker whose leg was amputated during the course of a docking maneuver.
In every case, the Group's attorneys attempt to resolve tort matters at the earliest possible time whether by dispositive motions or by settlement. However, the Tort Defense Group is comprised of capable trial attorneys who are well equipped to try any case to verdict, and to achieve successful results for the Group's clients.
In appropriate cases, we recommend use of alternative dispute resolution techniques such as arbitration and mediation. The members of the Group have been actively involved in the creation of several of the Court-Annex ADR Programs which are currently in operation and have a thorough understanding of the advantages and disadvantageous of such programs. We have found that the use of ADR Programs in appropriate cases can result in significant savings. The members of the Group have the opportunity to use their ADR skills regularly by serving as private and court appointed arbitrators, special masters, mediators and adjunct settlement judges.
Several members of the Tort Defense Group are also actively involved in teaching trial advocacy to lawyers. Two of the members of the Group have been elected to membership in the Academy of Trial Lawyers of Allegheny County, and all members are associated with the local, state and national bar associations.
